Utah Eviction Process

To start an eviction action you should first contact our office, either by telephone or email.  If necessary, we will set an appointment to meet in person to discuss your case.  To proceed, we must receive a property address, a copy of any lease, the name of tenant(s) and

If this eviction is for non-payment of rent, please provide:

  • The date through which rent has been paid
  • The amount of any refundable deposit paid
  • The total amount owed and unpaid (please itemize this amount, e.g., unpaid rent, late fees, water, sewer, electric)

    If this eviction is for a reason other than non-payment of rent, please explain the basis for the eviction.

Arrangements for payment and establishing a retainer can be arranged at the time of the initial contact.  At the time we review your case, we can provide you with cost estimate and the amount of any retainer that may be required.  Crippen & Cline bills on a flat fee basis for certain procedures that are common in eviction actions. This means the a standard rate is charged, even though the charge may be greater if charged on a hourly basis. If additional non-itemized legal service are required, those services are charged at standard billing rates based on time and expense.  For a list of current flat fee charges, please call or email our office.

If the eviction action is contested, the cost of the work will usually increase, depending on the amount of work required to successfully complete the action. A contested eviction action will almost always cost more than an uncontested eviction action.  If you would like to make special payment arrangements or have specific questions, please call our office at anytime.

WE MAKE EVERY EFFORT TO BE AS EFFICIENT AS POSSIBLE. IF YOU BECOME AWARE THAT THE TENANT HAS VACATED THE PROPERTY, PLEASE IMMEDIATELY ADVISE US SINCE THAT MAY REDUCE THE AMOUNT OF WORK REQUIRED TO COMPLETE THE EVICTION. AFTER YOU HAVE RETAKEN POSSESSION OF THE PREMISES, IT IS YOUR RESPONSIBILITY TO ADVISE US OF THE AMOUNT OF DAMAGES, IF ANY, TO THE PROPERTY THAT IS NOT COVERED BY ANY SECURITY DEPOSIT.

  2. Notice is served
  3. Complaint is filed
  4. Summons and Complaint is served
  5. Date of rent nonpayment hearing (if applicable)
  6. Order of Restitution submitted to Court
  7. Order of Restitution is signed
  8. Order of Restitution sent for service
  9. Judgment submitted to Court
  10. Judgment signed
